KNEC Offers Opportunity to Students With Cancelled Exams to Appeal. Students whose national examinations were canceled were given the chance to appeal to the Kenya National Examinations Council (KNEC).
This is captured in the Kenya National Examinations Council (Amendment) Bill 2024 prepared by the Presidential Task Force on Education Reforms.
Under the bill, aggrieved students will be able to appeal the cancellation 30 days after the results are released.
“A candidate whose examination results have been cancelled, may, within thirty days after the publication of the results, apply to the Council for a review of the Council’s decision,” reads part of the bill.
While in the past students had to use the court system to obtain redress, in the future KNEC will accept applications from aggrieved candidates, which must be submitted in writing.
Students must state specifically why they are requesting a review.
“After receiving the application, the council will assess the application and respond to the applicant in writing within thirty days,” the draft law reads.
Students will be afforded the courtesy of being told why their request for review has been denied by the Board.
If the review request is successful, the student will receive written notification of the decision.
In addition, the KNEC will require the applicant to appear before the Board within 90 days of a successful application for review.
“If the Board is satisfied that the candidate was not involved in any examination irregularities, it shall communicate the results to the candidate,” the bill proposes.
The bill is currently subject to public participation before it is presented to Parliament for consideration.
